The architect’s main aim is to create buildings that satisfy the needs of their clients, acting as far as is practicable in their best interests. However, the development of the design and the way that it can be built are both subject to the interests and concerns of a number of independent organisations or authorities, who are empowered to control the full progress and set the proper areas of law that affect the designers, the design and the construction as buildings are created.
In Spain, the Building Act (L.O.E. – Ley de Ordenación de la Edificación – Ley 38/1999) establishes what kind of technicians are allowed to be in charge of the design of the different types of buildings. Only registered architects are allowed to carry on the design of residential projects, no matter whether it is a new construction project, an existing building renovation, a major rehabilitation, etc. The consequences of legislation and advice must be incorporated into proposals at various stages throughout the design and construction periods so that necessary approvals are secured.

Once the design phase is completed, the architect and/or other technicians from the design team must carry on the supervision of the building process. His duty is to oversee that the building is constructed in accordance with the contract documents, and witness the contractor and subcontractors as they carry out their work. They will also help the contractor to understand the complexities of construction, to resolve any difficulties as they arise, and to ensure the formal inspections by external authorities. Once again, the supervising technicians are set by the Building Act (L.O.E.) in Spain.
